CAPSA USA LLC., d.b.a. CAFFENIO, (“CAFFENIO”, “us”, “we” or “our”) provides this Privacy Notice (“Notice”) to describe the types of Personal Information (as defined below) collected by or on behalf of CAFFENIO through our website located at www.Caffenio.com/us (the “Site”), our US mobile application (“Mobile Application”), and visits to our US store locations (collectively, with the Site and Mobile Application, the “Services”) and the practices we take when we collect, use, share, and protect your Personal Information.   At CAFFENIO we are committed to the protection of your Personal Information, through compliance with this Notice, and relevant privacy laws and regulations. 

CAFFENIO RESERVES THE RIGHT TO MODIFY THIS NOTICE AT ANY TIME. ALL CHANGES WILL BE EFFECTIVE IMMEDIATELY UPON POSTING TO THE SITE.  MATERIAL CHANGES WILL BE VISIBLY POSTED ON THE SITE OR OTHERWISE COMMUNICATED TO YOU.

  • Information We Collect

We may collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or about you (“Personal Information”) when you use our Services.

We collect several types of Personal Information from and about users of our Services. Information we collect may include: 

  • Contact Information, such as your name, address, zip code, mobile phone number and email address. 
  • Demographic information, such as your date of birth.
  • Account information, if you set up an account, such as your username and password and account transactions.
  • Transaction and anticipated transaction information, such as your order history, purchase frequency, rewards points you use, products you browse or place in your shopping cart, and your signature at point of sale. 
  • Electronic information such as your internet browsing history, search data, browser type, IP address, device identifier, mobile advertising identifier, internet service provider, and analytics related to your interactions on the Site or Mobile Application.
  • Interactions that you have with us, such as emails, call recordings, security video from store visits, surveys that you respond to, and promotions with which you participate.  
  • General geolocation information, such as your IP address and approximate location data obtained through wifi, WLAN or bluetooth access points.
  • Sources Of Information 

Information You Provide Directly to Us. 

We collect the Personal Information that you provide us.  When you utilize our Services, we may ask you for certain Personal Information and in some instances, Personal Information is required to use certain features on our Site or Mobile Application. For example, to place an online order on our Site or through our Mobile Application, you must first complete an account registration and input your name, email address, and other Personal Information to be verified for eligibility to purchase goods. In addition, if you respond to communications from us, enroll to receive communications from us, enter promotions, or otherwise interact with us, such interactions may require us to collect Personal Information.  

We also collect the Personal Information you provide if you elect to sign up to our rewards program.  The MI CAFFENIO rewards program is the way in which we reward and thank our customers for the preference and loyalty to consume in our CAFFENIO points of sale. For details on the MI CAFFENIO loyalty program, please click here. We will collect your Personal Information in connection with your participation in our loyalty program. For example, when you register for participation with the MI CAFFENIO rewards, you will be required to provide your full name, password, date of birth, PIN (personal identification number), email address, and cell phone number. 

Order & Payment Data.  When you make a purchase we use a PCI-compliant payment processor to help us facilitate payment.  We have contracted with such payment processor to ensure they protect and limit the use of your Personal Information. CAFFENIO does not receive your credit card, debit card, or other financial information when you make a payment- such information is provided directly to our payment processor.  However, CAFFENIO does receive information about your purchase and your contact information (e.g., name, email address, mailing address, phone number).  CAFFENIO will keep a record of your purchases.   • Information from Third Parties. 

We may receive your information from various third-party companies, such as social media platforms and data brokers.  We may combine our data with information provided by such third-party companies. By combining our data with data collected from third party companies we can improve our ability to market our products to you. 

We are active on social media, including Facebook, TikTok, YouTube, Twitter, Instagram, Snapchat, and LinkedIn (“Social Media”). Anything you post on Social Media is public information and will not be treated confidentially. We may post (or re-post) on the Site and our Social Media pages any comments or content that you post on our Social Media pages. 

The Site allows you to connect and share data with Social Media platforms. These features may require us to use cookies, plug-ins, and APIs provided by such Social Media platforms to facilitate those communications and features. The Site may use advertising networks and services offered by Social Media platforms to deliver advertising content. Use of these services requires Social Media platforms to implement cookies or pixel tags to deliver ads to you while you access the Site.

Your use of Social Media is governed by the privacy policies and terms of the providers that own and operate those websites and not by this Notice. We encourage you to review those policies and terms.

  • Information from Automated Data Collection Technologies. 

In some instances, Personal Information may be automatically collected when you use our Services.

  • Physical locationsWhen you visit a location, we may have security and other electronic tools at such physical location that may record your presence and activity at that location.
  • Wifi or Bluetooth devicesWhen you visit a location and have your wifi or bluetooth enabled on your device, we may collect information about your device and its use of our electronic networks at that location.  
  • Account Activity. We may collect data about how you use (i) your online account, and (ii) the Site when you are logged into your account. 
  • Maps. The Site and Mobile Application contain maps provided by third parties and/or service providers for your convenience. These maps may be provided using APIs and tracking technologies made available by the third party map provider.  CAFFENIO and the map provider may collect data about how you interact with the maps. For example, Google may collect usage data on maps embedded on the Site. Even if you do not interact with the maps, Google may still collect certain information about your interactions with our Site if you are signed into your Google account when accessing our Site.   • Site and Mobile Application Cookies and Tracking Technologies.  
    • Your computer or mobile device may allow for certain information to be automatically collected from you when you access our Site or Mobile Application.We may use cookies, web beacons, pixel tags and other tracking technologies (collectively “Cookies“) on our Site and Mobile Application.  A cookie is a small text file that our Site saves onto your computer or device when you use the Site that provides us certain information about your activities.  Cookies allow the Site to remember your actions and preferences and recognize you or your browser, along with some information you provided.  Web beacons / pixel tags are small graphics on a webpage that monitor your activity when viewing a webpage.
    • Most browsers automatically accept cookies. You can disable this function by changing your browser settings but disabling Cookies may impact your use and enjoyment of the Site.  Not all features or functions of the Site may work properly if you disable Cookies.  You cannot disable all Cookies, such as Cookies that are essential to the functioning of the Site.
    • The Cookies on our Site may collect information such as:
  • IP addresses assigned to the computers and other devices you use;
  • your internet service provider;
  • device ID number;
  • approximate geographic location;
  • browser type;
  • Site pages visited;
  • websites you access before and after visiting the Site; and 
  • data related to how and when you use the Site. 
  • How We Use Your Information

Generally, we will only use Personal Information for the purposes for which the information was provided to us and as otherwise set forth below.  These uses of your Personal Information include:

  • Complying with Legal Obligations: To comply with applicable law or legal processes served on us. 
  • Service fulfillment: To provide you the products, Services, or information that you may have requested (e.g., to process or fulfill orders, to support or improve our loyalty program).
  • Business Communications: To communicate with you relating to changes in policies, confirmation of transactions, and reply to any inquiry, complaint, or concern you have sent to us.
  • Rights Enforcement: To protect our property and rights including enforcement of our Terms, rights, agreements, and policies. 
  • Security and Reduction of Fraud:  To help detect and reduce security issues, fraud and illegal transactions, including exchanging information with other companies and organizations for the purposes of preventing, detecting, and investigating potentially prohibited or illegal activities and assisting in the investigation of suspected illegal or wrongful activity. 
  • Research, Development, and Improvement of Our Services: To review surveys, research, and analytics data for insight into on how users perceive our Services and products and assess the effectiveness of our sales, online services, marketing, and advertising with the goal of improving our Services.
  • Aggregate Data:  To generate aggregated statistical, demographic or purchasing behavior data, information and analyses.
  • Record Keeping: To keep accurate and up to date records regarding customer access, visits, purchases, and interactions with our Services and offerings. 
  • Maintenance: To ensure the functioning of our Site and Mobile Application and operate or conduct maintenance and repair of our equipment, Site and Mobile Application. 
  • Validation of Submitted Information: To verify the authenticity and accuracy of any Personal Information submitted directly to us. 
  • Marketing and Targeted Advertising: To provide you with marketing, targeted advertising, offers, and promotions that you may be interested in. 
  • Analytics:  To monitor and collect analytics about your use of the Site. We use Google Analytics and other third party analytic tools for this purpose.  
    • Google sets Cookies on your browser or device, and then your web browser will automatically send information to Google. Google uses this information to provide us with reports that we use to better understand and measure how users interact with our Site. We may also implement additional add-on services to Google Analytics, such as demographics and interest reporting, remarketing with Google Analytics, and Google Ads Networks. 
    • We use Salesforce, provided by Salesforce, Inc. to provide analytics services to us through our mobile application. The information stored in this system includes contact data such as your name, email or phone number and tracks your behaviors in our application.   • Online Behavioral Advertising: We may also use Cookies and other tracking technologies via third parties and/or service providers to provide interest-based advertising to you. Our service providers may serve advertisements to you on our behalf that are customized based on predictions about your interests generated from your visits to websites (including the Site) over time and across different websites. The data collected may be associated with your Personal Information. These advertisements may appear on the Site and on other websites, and may be sent to you via email.  

To change your preferences with respect to certain online ads or to obtain more information about ad networks and online behavioral advertising, visit National Advertising Initiative Consumer opt-out page or the Digital Advertising Alliance Self-Regulatory Program. Changing your settings with individual browsers or ad networks will not necessarily carry over to other browsers or ad networks. As a result, depending on the opt-outs you request, you may still see our ads. Opting out of targeted advertising does not opt you out of all ads, just those targeted to you.

  • Overview

Caffenio provides SMS-based Two-Factor Authentication (2FA) as an additional security measure to protect your account. By opting in to this service, you agree to receive text messages (SMS) for authentication and verification purposes.

  1. How It Works

When logging into your account or performing certain actions, you may be required to enter a one-time verification code sent via SMS.

You must enter the code correctly to complete the authentication process.

Standard message and data rates may apply depending on your carrier and mobile plan.

  1. Opting In

By creating an account with Caffenio, you acknowledge and accept that SMS verification is required as part of the authentication process.

No separate opt-in is required, as this service is solely for security purposes.

  1. Opting Out

Since SMS-based authentication is a security feature, opting out may limit your ability to access or use certain services.

If you wish to disable SMS authentication, alternative authentication methods may be required. Contact Caffenio Support for assistance.

  1. Message Frequency

You will receive an SMS only when attempting to log in or complete an action that requires verification.

Caffenio does not send promotional or marketing messages through this authentication channel.

  1. Cost

Caffenio does not charge for SMS verification messages. However, your mobile carrier’s standard messaging and data rates may apply.

If you are not receiving verification messages, check with your mobile carrier to ensure SMS delivery is not blocked.

  • How We Disclose Your Information 

We may disclose your Personal Information to personnel at CAFFENIO, as well as the following third parties for the purposes disclosed above and as further set forth below: 

  • Affiliates. Our corporate parent, subsidiaries, and affiliates, for purposes consistent with this Notice.
  • Service providers. Third parties that provide services on our behalf or help us operate the Services or our business (such as payment processing, hosting, information technology, email delivery, marketing, shipping, point of sale processing, transaction processing, and website analytics).
  • Business and marketing partners. Third parties with whom we collaborate on joint activities, with whom we have entered into joint marketing relationships or other joint ventures.
  • Professional advisors. Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.  

  • How We Secure and Protect Your Information 

We rely on both technical and organizational measures to ensure that we observe relevant privacy and security laws to reduce the risk of loss, misuse, unauthorized access, unauthorized disclosure, or modification of your Personal Information. Unfortunately, no data transmission over the Internet or method of electronic storage is perfect. As a result, while we strive to protect your Personal Information, we cannot ensure or warrant the security of any information you transmit to us or from our Site and Mobile Application, and you do so at your own risk. Once we receive your transmission, we make reasonable efforts to ensure security on our systems.

  • Retention of Your Personal Information

We collect and retain Personal Information only to the extent necessary to accomplish the business purposes identified in this Notice, or as legally required. 

  • Children’s Privacy

CAFFENIO recognizes the importance of protecting the privacy of children online. Our Services are intended for general audiences and are not directed to children under the age of 13. We do not intend for our websites or online Services to be used by anyone under the age of 13. We do not knowingly collect, sell, or share information of consumers between the ages of 13 – 16.  Further, we require users to be at least eighteen (18) years old to sign-up for and use an account with us.  If you are a parent or guardian and believe we may have collected information about your child, we ask that you email us immediately at hearyou@caffenio.com with the words “Children’s Privacy” in the subject line.

  Links to Third Party Websites

Our Site contains links to third-party websites. These links are provided solely as a convenience to you.  We are not responsible for the privacy practices or content of linked third party sites and do not make any warranty or representation regarding the content or accuracy of materials on such sites. CAFFENIO does not make any warranty or representation regarding, or endorse, any linked third-party websites or the information appearing on their websites or any of the products or services described. The Personal Information you choose to provide to, or that is collected by, these third parties is not covered by our Notice. We encourage you to review the privacy policy of any third-party before submitting your Personal Information. If you decide to access linked third-party websites, you do so at your own risk.

  • International Transfer

CAFFENIO controls and operates our U.S. based Services from within Mexico. If you are accessing the Services, please be aware that information collected through our U.S.-based Services may be transferred to, processed, stored, and used in Mexico and the US. Our online privacy practices are governed by the laws of the United States and Arizona, which may differ from privacy laws in your state or home country. By using our Services, you are expressly consenting to the transfer to and from, processing, usage, sharing, and storage of your information in Mexico and the US. At this time, we ship only within the contiguous United States (we do not ship to: Alaska, Hawaii, Puerto Rico, the US Virgin Islands, or Canada).

  • Your Choices

You have choices with regard to the information you provide to us. The choices described below are limited to the email address, phone, or device used to make the choice and will not affect use of Services from other emails, phones, or devices. 

Communication Preferences: 

  • Email: We offer a variety of commercial emails and email newsletters. You can unsubscribe from emails and email newsletters by clicking the “unsubscribe“ button at the bottom of any communication. 
  • Telephone: You can opt-out of text alerts any time by replying “STOP,” or any alternative keyword we have shared with you.
  • Push Notifications: You can opt-out any time by adjusting your device settings.

Browser and Platform Controls: 

  • Cookie Controls: You can choose what cookies you allow our website to place onto your device. Please review the Information from Automated Data Collection Technologies section for more information. 
  • Global Privacy Controls: Some browsers and browser extensions support the Global Privacy Control (“GPC”) that can send a signal to the websites you visit indicating your choice to opt-out from certain types of data processing, including data sales. 
  • Do Not Track: Some browsers include a “Do Not Track” (“DNT”) setting that can send a signal to the websites you visit indicating you do not wish to be tracked. Our Site does not respond to browser DNT signals.
  • Mobile Advertising ID Controls: iOS and Android operating systems provide options to limit tracking and/or reset the advertising IDs.
  • Additional disclosures for California residents: 

These additional disclosures apply only to individuals who reside in California and are provided pursuant to the California Consumer Privacy Act, as modified by the California Privacy Rights Act of 2020 and its implemented regulations (the “CCPA”).

Categories of Personal Information We Collect: In the last twelve (12) months, we have collected the types of Personal Information described in Section 1 (Information We Collect). The types of Personal Information in Section 1 fall into the below categories under California law: 

  • Identifiers that can be used to identify you, such as your name, phone number, address, uername and password, email address, IP address, device ID, mobile advetising ID, birthdate, and demographic information
  • Consumer information such as your name, credit card or debit card number, addess, and phone number as contemplated under Cal. Civ. Code 1798.80(e)
  • Commercial information, including your rewards account, transactions and purchase history 
  • Internet Activity such as your browsing history, browser type, search history, and information regarding your interactions with your Site and Mobile Application
  • Geolocation
  • Audio and Visual Information, such as voice and video recordings when you call us or visit our store locations. 
  • Inferences drawn from the above to create a profile about you, which may reflect your preferences, characteristics, trends, predispositions, behavior, and attitudes.
  • Sensitive Personal Information, such as your rewards account login.

Categories of Sources From Which Personal Information is Collected: The categories of sources from which your Personal Information is collected is described in Section 2 (Sources of Information).

Purposes for Collecting Personal Information:  Our purposes for collecting your Personal Information are described in Section 3 (How We Use Your Personal Information). 

Categories of Third Parties / Services Providers With Whom Personal Information is Disclosed for a Business Purpose:  In the last 12 months we disclosed each of the categories of Personal Information listed above for the business purposes and to the categories of third parties and / or service providers described above in Section 4 (How We Disclose Information).

Disclosure of Sensitive Information: We have not used or disclosed sensitive personal information for any reason other than the reasons for which it was provided to us.  

Categories of Personal Information Sold/Shared:  In the preceding 12 months, under definitions pursuant to California law, we may have “sold” or “shared” Personal Information consisting of Internet Activity to third party service providers that provide analytic tools and online behavioral advertising for the purpose of engaging in and utilizing such tools and services.  We do not have actual knowledge that we have sold or shared any Personal Information of a minor under 16 years old.  

Retention:  We maintain your Personal Information for so long as we need it for the purposes for which it was collected and is used, taking into account applicable criteria such as our legal rights and obligations and commercial best practices for record-keeping.  

  • Privacy Rights: 

California residents have the following privacy rights: 

  • Right to Know – You have the right to request information as to whether we have collected Personal Information about you in the previous 12 months, what specific categories of Personal Information we have collected about you, the categories of sources from which it was collected, the business or commercial purposes for collecting, selling, or sharing it, and the categories of third parties to whom we disclosed, sold or shared it, and a list of categories of Personal Information we sold, shared or disclosed to a third party.
  • Access and Data Portability – You  have the right to request that we disclose to you the specific pieces of Personal Information that we have collected about you in the 12-month period prior to your request and receive a copy of your electronic Personal Information in a readily-usable format.
  • Deletion – You have the right to request that we delete Personal Information that we collected from you and retained.
  • Correct Inaccurate Information – You have the right to request that we correct inaccuracies in the Personal Information we maintain about you. 
  • Opt-out of Targeted Advertising –You have the right to opt-out of having your Personal Information sold or shared for purposes of targeted advertising.  To opt-out, click the “Do Not Share My Personal Information”   .  Some web browsers allow consumers to automatically exercise their right to opt-out of sale/sharing with all businesses they interact with online by initiating an opt-out preference signal. We will honor such opt-out preference signals.
  • Right to Non-Discrimination – Individuals choosing to exercise any of their rights will not be discriminated against based solely upon exercising the above rights.

You must provide sufficient information to allow us to reasonably verify you are the person about whom we collected Personal Information, and you must describe your request with sufficient detail to allow us to properly understand, evaluate, and respond to your request. You may also submit a request through an authorized agent.  We may request additional information to verify identity and the authenticity of the request before we respond, which information may vary depending on the nature of your request and whether or not you are the data subject or the agent.  We will respond to your request within the timeframes as required by applicable law.  We may charge a fee to process or respond to your request if it is excessive, repetitive, or manifestly unfounded.

  1. Notice of Financial Incentives

We offer a loyalty program that provides benefits such as rewards points and discounts to those who choose to participate. From time to time, we also offer discount codes, coupons, or offers for free products that require a sign-up. Participation requires you to provide some Personal Information, such as Identifiers, Personal Records, Internet or other electronic network activity information, and Commercial Information. The financial incentives associated with our loyalty program are designed to reward loyal customers for continuing to purchase our products. Based on our reasonable and good faith estimate, we receive value from our MI CAFFENIO® loyalty program in increased customer loyalty and support, though any value will vary by member depending on purchases made, which offers a member takes advantage of, and many other factors. By joining our loyalty program, you consent to any financial incentive associated with the Program. You have the right to withdraw from the financial incentive at any time by cancelling your participation in the Loyalty Programs. To cancel your participation, please formalize your request by calling us at 877-432-7987 or via email at hearyou@caffenio.com

Shine the Light.  Pursuant to California Civil Code Section 1798.83, if you are a California resident, you have the right to obtain: (a) a list of all third parties to whom we may have disclosed your Personal Information within the past year for their direct marketing purposes for their products and services, and (b) a description of the categories of Personal Information disclosed, by contacting us per the “Contact Us” Section below.
